A chiropractic practice is generally a HIPAA covered entity when it transmits health information electronically in a covered transaction, typically submitting electronic claims to insurance, Medicare, or Medicaid, or checking eligibility electronically. Under 45 CFR 160.103 the trigger is the electronic covered transaction. Most insurance-billing chiropractors meet this test; a strictly cash/membership practice that never bills electronically may not. Confirm your status.

Are you even a covered entity?

Chiropractic billing is heavily insurance-driven (and Medicare covers manual spinal manipulation), so most chiropractors file electronic claims and are covered. The line is whether YOU electronically transmit the covered transaction: if your office or your billing service/clearinghouse files claims, checks eligibility, or receives remittances electronically, you're generally covered. A genuine cash-only or wellness-membership practice that never files electronically, and gives patients only paper superbills, may fall outside HIPAA, though state record laws still apply.

HIPAA considerations specific to chiropractors

Chiropractic records routinely include spinal X-rays and imaging; these are PHI and must be covered by your privacy/security policies and your Security Risk Analysis.
Personal-injury and motor-vehicle-accident cases mean frequent disclosures to attorneys, auto insurers, and case managers; these third-party releases need valid authorizations and minimum-necessary handling.
Medicare imposes strict documentation rules for chiropractic (e.g., the AT modifier and demonstrating medical necessity), so claim data and notes that flow electronically are PHI inside covered transactions.
Many chiropractors sell supplements and run open adjusting bays, creating reasonable-safeguard challenges for oral PHI and check-in PHI in shared treatment spaces.
Multidisciplinary clinics (chiro + massage + PT) share one record system, so role-based access and BAAs must reflect everyone who touches the ePHI.
